Services

Your Next Website provides website-related services including WordPress website design and development, custom website builds, ecommerce and online shop development, website redesigns and updates, landing pages, website maintenance and related services, consultations, project planning, project scope documents, and related digital services agreed in writing.

The exact services, deliverables, price and estimated timeline for a project will be set out in the applicable quotation, proposal, scope or invoice.

02

Quotations

Initial website quotations are provided free of charge unless otherwise stated.

A quotation is an estimate based on the information supplied by the client at the time it is prepared. Any work, functionality, integrations, pages or requirements not included in the accepted quotation may be quoted separately.

We will not charge additional amounts outside an accepted quotation without first informing the client and obtaining approval where required.

03

Paid Consultations

A live consultation may be offered at a fee published on our website or communicated before booking. The consultation fee covers our professional time, review and advice.

Unless otherwise stated, where a client proceeds with an eligible website project with Your Next Website, the consultation fee may be credited against the final project invoice.

If the client does not proceed with the project, the consultation fee remains payable and is not refundable once the consultation has taken place.

04

Project Scopes and Planning Services

Detailed project planning, website audits, technical recommendations, specifications or project scope documents may be offered as a paid service.

The fee covers the professional time required to analyse the project and prepare the material. Where expressly stated before purchase, the scope or planning fee may be credited against the client’s project invoice if Your Next Website is appointed to carry out the build.

Once the scope or planning work has been completed or materially commenced, the fee is not refundable except where required by applicable law.

05

Deposits and Commencement of Work

A deposit or upfront payment may be required before project work begins.

Work will only be scheduled once any required payment has been received and the information reasonably required to begin the project has been supplied.

By instructing us to begin services before the expiry of any applicable statutory cooling-off period, the client expressly requests that performance begin immediately. Applicable statutory rights remain unaffected.

06

Client Responsibilities

The client is responsible for supplying requested materials reasonably required to complete the project, including where applicable text and website copy, logos and branding, images and media, product information, pricing, legal policies, login credentials, and domain or hosting details.

The client warrants that they have the right to use all materials supplied to us. Delays in supplying information, feedback, access or approvals may affect the project timeline.

07

Revisions

The number or scope of revisions included in a project will be stated in the quotation or proposal where applicable.

A revision means a reasonable change to work already produced within the agreed scope. New pages, new functionality, substantial redesigns, changes in project direction or requirements not originally agreed may be treated as additional work and quoted separately.

08

Project Timelines

Any completion date or timeline provided is an estimate unless expressly agreed otherwise in writing.

Timelines may change because of delayed client feedback, delayed delivery of content, third-party services, technical issues outside our reasonable control, approved changes to scope, or circumstances beyond our reasonable control.

09

Third-Party Services

Websites may rely on third-party products or services including WordPress, plugins, themes, hosting providers, domain registrars, payment gateways, email providers, APIs, analytics platforms, security or backup services.

We are not responsible for outages, pricing changes, discontinued services, policy changes or failures caused by third parties outside our reasonable control.

10

Website Updates and Maintenance

Unless an ongoing maintenance service is included in writing, delivery of a website does not create an unlimited obligation to provide future updates, support or maintenance.

Automated software updates reduce routine maintenance but cannot guarantee that third-party software will never conflict, fail or require manual intervention.

11

Approval and Launch

The client is responsible for reviewing the website before final approval. Once final approval is given, the website may be launched or handed over.

Minor defects caused by our implementation that fall within the agreed scope should be reported within thirty (30) days after launch so that they can be assessed and, where applicable, corrected.

12

Intellectual Property

Unless otherwise agreed, the client retains ownership of content and materials they supplied. Third-party software remains subject to its own licence terms.

Ownership of custom design or development work created specifically for the client transfers once all amounts due for that work have been paid.

We may retain ownership of reusable methods, systems, code libraries, processes and know-how that were not created exclusively for the client’s project.

13

Portfolio Use

Unless the client requests otherwise in writing, we may display completed public-facing work in our portfolio, case studies or promotional material. Confidential information will not intentionally be published.

14

Payment

Invoices must be paid according to the payment terms stated on the quotation or invoice. Where payment is overdue, we may pause work until the account is brought up to date.

Final files, website transfer, launch or ownership transfer may be withheld until outstanding project amounts have been paid.

15

Cancellation

A client may request cancellation in writing.

Any refund or amount payable following cancellation will be determined in accordance with our Refund Policy, the work already performed, commitments already incurred and applicable South African law.

16

Limitation of Liability

We will exercise reasonable care in providing our services. We are not liable for indirect or consequential loss arising from matters outside our reasonable control, including third-party outages, hosting failure, malware introduced after handover, changes made by the client or another service provider, lost search rankings, lost profits or loss of business opportunity.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

17

Results and Marketing Performance

We do not guarantee specific Google rankings, a particular number of leads, specific sales volumes, advertising performance, conversion rates, or business revenue.

Website performance depends on factors including the client’s offer, market, pricing, traffic, sales process and ongoing marketing activity.

18

Privacy

Personal information submitted through our website or during a project will be handled in accordance with our Privacy Policy and applicable South African law.

19

Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Nothing in these Terms removes any mandatory rights available to consumers under South African law.

Hosting Subscriptions

Hosting plans are provided on a recurring subscription basis at the price displayed at the time of purchase, unless otherwise agreed in writing.

Hosting subscriptions automatically renew according to the billing cycle selected at checkout until cancelled.

You are responsible for ensuring that your payment details remain valid and that subscription payments are made when due.

If a hosting payment fails or remains unpaid, we may suspend the hosting service after reasonable notice. Continued non-payment may result in termination of the hosting account. Where possible, we will provide an opportunity to resolve an overdue payment before permanent removal of hosted data.

You may cancel your hosting subscription by contacting hello@yournextwebsite.co.za. Cancellation will normally take effect at the end of the current paid billing period unless otherwise agreed or required by law.

Cancellation of hosting does not automatically cancel or transfer ownership of a domain name. Domain transfers, renewals and expiry are handled separately where applicable.

Where a hosting package includes a free domain, the offer is subject to domain availability and eligible domain extensions. Premium domains, certain extensions, transfers, restoration fees and future domain renewal fees may not be included unless expressly stated.

Hosting resources, features and infrastructure may be supplied through third-party hosting providers. We may make reasonable technical or infrastructure changes where required to maintain or improve the service.

Clients remain responsible for the legality and content of material hosted through their account. Hosting may not be used for unlawful, abusive, malicious, fraudulent or otherwise prohibited activities.

We may suspend or terminate hosting where reasonably necessary to protect our systems, third-party infrastructure, other users, or to comply with applicable law.

Where a hosting service is terminated, clients are responsible for arranging any required migration or backup of their website, email or other data before the termination date.

Nothing in this section limits any rights that cannot legally be excluded under applicable South African law.

Consumer Rights Remain Protected
